Terms of Service
Effective September 25, 2026
These terms are an agreement between you and Aspen Ventures, LLC, doing business as Barney Goose (“we”, “us”), the maker of Gramo. They cover the Gramo service: the Gramo app, the web app at app.hellogramo.com, and the online service that Gramo boxes connect to. Using Gramo means you agree to these terms and to our Privacy Policy.
These terms don’t cover buying a Gramo box. A $1 reservation is covered by the terms on our reservation page. Terms for buying a box, including shipping, returns and the hardware warranty, will be published when sales open.
1. Accounts
- You must be 18 or older to create a Gramo account.
- You sign in with a code we email you. Keep your email account secure: anyone who can read your email can sign in as you.
- Give us an accurate email address, and only one account per person.
- You’re responsible for what happens under your account.
2. Your licence to use the app
We give you a personal, non-exclusive, non-transferable, revocable licence to install and use the Gramo app on devices you own or control, only to use the Gramo service under these terms. If you got the app from the App Store, you may use it only on Apple-branded products, as Apple’s Usage Rules allow. We and our licensors keep all other rights in the app and the service, including the Gramo and Barney Goose names and logos.
3. Kids and Gramos
Kids don’t have accounts. They use a Gramo box that a grown-up sets up.
- Only set up a Gramo for a child you are the parent or legal guardian of, or whose parent or guardian has agreed to it.
- By connecting a Gramo, you consent to that child’s voice messages being collected and shared with the Pod you choose, as our Privacy Policy describes.
- You decide which Pod a Gramo is in, and you can remove it at any time.
4. Pods
- The grown-up who creates a Pod is its owner. The owner sets the Pod’s rules, can remove grown-ups and Gramos, and can delete the Pod.
- Every grown-up in a Pod can hear every message in it. Every grown-up can send messages to it, and can invite others.
- Invite only people you know and trust. Anyone you invite can hear the kids in that Pod.
- Messages are deleted automatically 30 days after they’re sent. Gramo is not an archive. If you want to keep a message, save it yourself before then.
5. What you can’t do
Don’t use Gramo to:
- record or send anything illegal, threatening, harassing, sexual, or harmful to a child;
- record someone who hasn’t agreed to it, where the law requires their consent;
- impersonate someone, or join a Pod you weren’t invited to;
- interfere with, reverse-engineer, overload or probe the service. Security research reported to [email protected] in good faith is welcome;
- resell or commercially exploit the service.
We may remove content, remove someone from a Pod, or suspend or close an account that breaks these rules or puts a child at risk. We report apparent child exploitation to the authorities.
6. Your content
- You keep ownership of the messages you and your kids record.
- You give us permission to store, copy, process and deliver them, only to run Gramo for your Pod. That permission ends when the messages are deleted.
- We don’t use your messages for advertising or to train AI models.
7. Not for emergencies
Gramo is not a phone and cannot reach emergency services. A message may be delayed, or may not arrive: a box can be offline, unplugged or out of Wi-Fi range. Don’t rely on Gramo when timing or safety matters.
8. The service
We work to keep Gramo running reliably, but we don’t promise it will always be available or free of errors. We may change features over time. We update the app and the box’s software automatically, and some updates are needed for Gramo to keep working.
Our commitment on the service’s future:
- We’ll keep the Gramo service running for at least three years from launch, meaning the day Gramo boxes first ship to customers.
- If we ever stop running it, we’ll give account holders at least 90 days’ notice by email.
- Before the service shuts down, we’ll release firmware and instructions so every Gramo can keep working on your own network, or so you can run the service yourself.
9. Fees
The Gramo app and service are currently included with a Gramo box, at no extra charge. If we ever introduce a paid feature, we’ll tell you first. You won’t be charged for anything you haven’t agreed to.
10. Ending your account
You can delete your account at any time in the app (Settings, then Delete account), or by emailing [email protected]. We may suspend or close accounts that break these terms. Sections 6 (only for as long as content still exists), 11, 12, 13 and 14 survive after your account closes.
11. Disclaimers
To the extent the law allows, the Gramo service is provided “as is” and “as available”. We disclaim all warranties not stated in these terms, including merchantability, fitness for a particular purpose and non-infringement. Your hardware warranty is separate and is not affected by this section. Some places don’t allow these disclaimers, so they may not apply to you.
12. Limitation of liability
To the extent the law allows:
- We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost data or messages.
- Our total liability for any claim about the service is limited to the greater of the amount you paid us in the 12 months before the claim, or US$100.
Nothing in these terms limits liability that cannot be limited by law.
13. Disputes
These terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-law rules.
Before starting a formal claim, please email [email protected], and we’ll try to resolve it with you within 60 days.
Any claim that isn’t resolved that way goes to the state or federal courts in Sheridan County, Wyoming. You may instead bring an individual claim in small-claims court where you live.
14. Apple and Google
If you downloaded the app from the App Store or Google Play, these terms are between you and us, not Apple or Google.
- Apple and Google are not responsible for the app or its support.
- For the iOS app, Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them.
- Apple has no obligation to provide maintenance or support. Its only warranty obligation is to refund the purchase price, if any, where the law requires it.
- We, not Apple, are responsible for any claim about the app, including product liability claims, claims that it fails to meet a legal or regulatory requirement, and consumer-protection or privacy claims.
- If anyone claims the app infringes their intellectual property, we, not Apple, are responsible for investigating, defending and settling that claim.
- You confirm that you aren’t located in a country subject to a U.S. Government embargo, and aren’t on any U.S. Government list of prohibited or restricted parties.

15. Changes
We may update these terms. If a change is significant, we’ll tell account holders by email at least 14 days before it takes effect. If you keep using Gramo after that, you accept the new terms. If you don’t agree, you can delete your account.
